Chapter One: Introduction
1.1 Background of the Study
The Nigerian Constitution guarantees the fundamental human rights of all citizens, including those of students in public schools. These rights, enshrined in Chapter IV of the Constitution, are meant to ensure access to education, freedom from discrimination, and the protection of individual dignity in educational settings (Aliyu & Bello, 2023). However, the enforcement of these rights in public schools, especially in Yola North LGA, Adamawa State, remains an area of concern. Issues such as corporal punishment, gender discrimination, and inadequate facilities continue to undermine the quality of education and the rights of students. Despite national and international human rights frameworks, there appears to be a disconnect between policy and practice in many public schools (Musa & Salim, 2024). This study seeks to assess how well fundamental human rights are enforced in public schools in Yola North LGA, focusing on challenges and the roles of school authorities and government agencies in upholding these rights.
1.2 Statement of the Problem
Despite the legal provisions for the protection of students’ rights in Nigerian public schools, Yola North LGA continues to experience instances of human rights violations in schools. These violations include issues related to corporal punishment, lack of gender equality, and substandard learning environments. This study will investigate the effectiveness of enforcing fundamental human rights in public schools in the area.
1.3 Objectives of the Study
To evaluate the enforcement of fundamental human rights in public schools in Yola North LGA.
To identify the challenges in ensuring the protection of students' rights in these schools.
To provide recommendations for improving the enforcement of fundamental human rights in public schools in Yola North LGA.
1.4 Research Questions
To what extent are fundamental human rights enforced in public schools in Yola North LGA?
What are the major challenges in enforcing these rights in the area?
What strategies can be adopted to improve the enforcement of fundamental human rights in public schools in Yola North LGA?
1.5 Research Hypothesis
H₁: Fundamental human rights are not adequately enforced in public schools in Yola North LGA.
H₂: Lack of awareness and inadequate monitoring mechanisms hinder the enforcement of students' rights in Yola North LGA.
H₃: Strengthening the enforcement of human rights policies will improve the learning environment in public schools in Yola North LGA.
1.6 Significance of the Study
This study will provide important insights into the current state of human rights enforcement in public schools in Yola North LGA, helping educational authorities, policymakers, and human rights advocates better understand the challenges and propose solutions for improving students' rights protection.
1.7 Scope and Limitations of the Study
The study will focus on public schools in Yola North LGA, Adamawa State. Limitations may include difficulty in accessing certain schools due to bureaucratic hurdles or resistance from school authorities in discussing human rights violations openly.
1.8 Operational Definition of Terms
Fundamental Human Rights: The basic rights and freedoms to which all individuals are entitled, including the right to education, freedom from abuse, and the right to non-discrimination.
Enforcement: The act of ensuring compliance with laws or regulations, in this case, regarding the protection of students' human rights in schools.
Public Schools: Government-funded educational institutions that provide free or affordable education to students.
